Email Canvas Pro Terms and Conditions

These Terms and Conditions govern your access to and use of Email Canvas Pro, EmailCanvasPro.com, the Email Canvas Pro application, subscription services, member areas, templates, content blocks, design tools, exported files, and related services.

For purposes of these Terms, “Email Canvas Pro,” “we,” “our,” or “us” refers to the provider of Email Canvas Pro. “You” and “your” refer to the individual or organization that creates an account, starts a trial, purchases a subscription, or otherwise accesses or uses Email Canvas Pro.

By creating an account, beginning a trial, purchasing a subscription, submitting payment information, accessing the application, or otherwise using Email Canvas Pro, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you should not create an account, subscribe to, access, or use Email Canvas Pro.

1. About Email Canvas Pro

Email Canvas Pro is a subscription-based software application designed to help users create, customize, save, and export professional email templates.

The Service may include a drag-and-drop email builder, professionally designed templates, custom HTML blocks, text and headline blocks, image blocks, buttons, calls to action, columns, dividers, spacers, reusable content blocks, formatting controls, template storage, preview tools, and export functionality.

We may add, modify, replace, improve, restrict, or discontinue features as the Service develops.

2. General Terms of Use

You agree to comply with these Terms in order to remain an authorized user of Email Canvas Pro.

Your use of Email Canvas Pro constitutes your acceptance of these Terms. If you no longer agree with these Terms, you must discontinue use of the Service.

Unless expressly authorized by us, you may not reproduce, duplicate, copy, sell, trade, sublicense, rent, redistribute, or resell Email Canvas Pro, access to Email Canvas Pro, or substantial portions of its proprietary templates or design library as a competing product or service.

You are responsible for maintaining the confidentiality of your username, password, and other account credentials and for activity conducted through your account.

If you become aware of unauthorized use of your account, you should notify Email Canvas Pro promptly.

3. Email Canvas Pro Is a Template Creation Tool

Email Canvas Pro is primarily a design and template creation application.

You may create email designs using Email Canvas Pro and export, copy, download, or otherwise transfer those designs for use with compatible third-party email platforms.

Your email service provider is responsible for transmitting your email messages. Email Canvas Pro does not control the delivery infrastructure, sender reputation, spam filtering, recipient servers, inbox placement, bounce processing, unsubscribe systems, or sending policies of third-party services.

4. Registration and Account Information

Access to certain portions of Email Canvas Pro requires registration.

You agree to provide accurate, complete, and reasonably current information when registering for or maintaining an account.

You are responsible for maintaining the confidentiality of your account credentials and agree not to distribute, transfer, rent, sell, or resell access to your account.

Your subscription is intended for the authorized subscriber or users permitted under the subscription plan you purchased.

Unauthorized sharing of account credentials may result in suspension or termination of the account.

5. Subscription Fees and Payment

Email Canvas Pro may offer monthly, annual, promotional, trial, or other subscription plans.

Subscription rates, billing periods, features, and discounts may vary depending upon the plan or offer you select.

The price applicable to your subscription will be disclosed when you enroll.

By submitting a payment method, you authorize Email Canvas Pro and its payment processor to charge the applicable subscription fees, renewal fees, and applicable taxes associated with your selected subscription.

Your obligation to pay subscription charges is based upon enrollment in and continued availability of the Service during your subscription period and does not depend upon how frequently, or whether, you choose to use Email Canvas Pro.

If Email Canvas Pro remains available to you during an active subscription period, your personal decision not to access or use the Service does not relieve you of your payment obligations and does not entitle you to reimbursement.

Unless you enroll through a free trial or another offer expressly providing otherwise, your paid subscription begins on the date your enrollment and payment are successfully processed.

6. Monthly and Annual Subscription Plans

Email Canvas Pro may offer both month-to-month and annual subscription plans.

Monthly subscriptions continue on a month-to-month basis until canceled. There is no long-term commitment associated with a standard monthly subscription unless a specific offer expressly states otherwise.

Annual subscriptions provide access to Email Canvas Pro for a 12-month subscription period and may be offered at a lower effective monthly cost than purchasing the Service on a month-to-month basis.

Annual subscriptions are ordinarily charged in full at the beginning of each annual subscription period unless the applicable offer specifically provides a different payment arrangement.

The amount you may save by choosing an annual subscription will be based upon the pricing displayed when you enroll. Future pricing, discounts, promotional offers, and subscription options may differ.

If you cancel a monthly subscription, your paid access will ordinarily continue through the end of the monthly billing period for which you have already paid.

If you cancel an annual subscription, your paid access will ordinarily continue through the end of the annual subscription period for which you have already paid.

Cancellation prevents future renewals but does not create a right to a partial refund or credit for unused time remaining in your current subscription period.

If your account remains inactive for an extended period, Email Canvas Pro may permanently delete some or all templates, designs, uploaded content, images, settings, or other data associated with the inactive account.

If deleted, this information may not be recoverable, even if you later reactivate your subscription or purchase a new subscription.

You are responsible for exporting, downloading, or otherwise maintaining copies of any templates or materials that you wish to preserve before canceling your subscription or allowing it to expire.

7. Free Trials

Email Canvas Pro may offer a free trial or promotional access period.

A free trial begins on the date you enroll in the trial, not on the date you first use the application.

If the applicable Email Canvas Pro offer provides a 30-day free trial, the trial period begins when you activate your trial by completing the enrollment process.

If payment information is collected when you begin the trial, you authorize Email Canvas Pro to retain and use that payment information in accordance with our Privacy Policy and the subscription terms disclosed during enrollment.

Failure to use Email Canvas Pro during a free trial does not extend the trial period. Trial periods are measured from the enrollment or activation date, regardless of how often you access or use the Service.

Unless expressly stated otherwise, a particular free-trial offer may be used only once by the same customer.

We may modify, replace, suspend, or discontinue future trial offers at any time. Changes to future offers will not alter rights already granted to an existing customer where prohibited by applicable law.

8. Refunds and Money-Back Guarantees

Email Canvas Pro does not provide prorated refunds or prorated credits for partially used subscription periods.

Subscription fees are charged for access to the Service during the applicable billing period, not according to the number of times you log in, the number of templates you create, the amount of time you spend using the Service, or the amount of value you personally obtain from the Service.

If you choose not to use Email Canvas Pro during a subscription period for which you have paid, that decision does not transfer responsibility for the unused time to Email Canvas Pro and does not create a refund obligation.

If Email Canvas Pro offers a money-back guarantee, free-trial promotion, accidental-renewal refund, or other refund program, the specific terms presented with that offer will govern eligibility.

Unless otherwise expressly stated in the applicable offer, a money-back guarantee applies only to a customer's first paid subscription to Email Canvas Pro.

A returning subscriber who previously purchased Email Canvas Pro may not be eligible for another introductory refund period or money-back guarantee.

This limitation is intended to prevent repeated enrollment, cancellation, and repurchase solely for the purpose of repeatedly obtaining free or refunded access to the Service.

Different plans, promotional offers, discounted plans, special packages, or third-party offers may have different refund policies. You should review the terms displayed with the particular offer before purchasing.

9. Automatic Renewal

Unless your subscription is specifically identified as non-renewing, Email Canvas Pro subscriptions automatically renew at the end of the applicable billing period.

By purchasing a recurring subscription, you authorize Email Canvas Pro and its payment processor to automatically charge your payment method for each renewal unless you cancel before the renewal date.

Monthly subscriptions ordinarily renew each month on or around the anniversary of your original enrollment date.

Annual subscriptions ordinarily renew once each year on or around the anniversary of your original enrollment date.

The applicable renewal price will be the price associated with your subscription at the time of renewal, subject to any pricing commitment, discount, promotion, or notice required by applicable law.

An introductory, promotional, or discounted annual rate does not necessarily guarantee that the same rate will apply to future renewal periods unless the offer expressly states otherwise.

If a billing date falls on a day that does not occur in a particular month, billing may occur on the last applicable day of that month.

10. Accidental Renewal Grace Period

We understand that customers occasionally intend to cancel a subscription but forget to do so before the renewal date.

If your Email Canvas Pro subscription automatically renews and you did not intend to renew it, you may request cancellation and a refund of the renewal payment within 45 days of the renewal date.

Refund requests submitted more than 45 days after the applicable renewal date are not eligible for the accidental-renewal refund unless otherwise required by applicable law.

This renewal grace period applies only to the applicable automatic renewal payment and does not create a recurring right to use the Service for extended periods and later request refunds.

The accidental renewal grace period does not alter our general policy that Email Canvas Pro does not provide prorated refunds for partially used subscription periods.

11. Cancellation

You may cancel your Email Canvas Pro subscription at any time through the cancellation method provided within your account or by contacting Email Canvas Pro support.

Cancellation prevents future subscription renewals but does not retroactively cancel or reduce charges for the current billing period.

If you cancel a monthly subscription, your paid access will ordinarily remain available through the end of your current monthly billing period.

If you cancel an annual subscription, your paid access will ordinarily remain available through the end of your current annual subscription period.

Any refund available under a separately stated money-back guarantee, accidental-renewal policy, promotional offer, or applicable law is an exception to this general policy and will be governed by the specific terms of that policy.

After your paid subscription ends, access to certain or all Email Canvas Pro features may be suspended or disabled.

You should export or otherwise retain copies of any templates or materials you wish to keep before your subscription expires or your account becomes inactive.

Email Canvas Pro will make reasonable efforts to send a cancellation confirmation to the email address associated with your account.

You should retain the confirmation as evidence of cancellation. If you do not receive confirmation, you should contact us to verify that your cancellation request was successfully received and processed.

12. Failed Payments

If a subscription or renewal payment fails, Email Canvas Pro or its payment processor may make additional attempts to collect the amount due.

If payment cannot be completed, we may suspend, restrict, downgrade, or terminate access to the Service.

Once a subscription becomes inactive because of a failed payment, the account may become subject to the same inactive-account storage and deletion policies described in these Terms.

13. Multiple Accounts

Creating or using multiple accounts for the purpose of avoiding subscription fees, trial limitations, refund restrictions, usage restrictions, or other account limitations is prohibited.

You should maintain one primary account unless your subscription plan expressly authorizes additional users or accounts.

Creating new accounts or using multiple email addresses for the purpose of repeatedly obtaining introductory offers, free trials, or refunds may result in termination of those accounts and loss of eligibility for future promotional offers.

14. Account Sharing

Your Email Canvas Pro account may not be shared with unauthorized individuals.

If your plan permits multiple authorized users, those users must comply with the limits of that subscription plan.

We may use reasonable technical measures to detect unusual or excessive simultaneous account access for the purpose of protecting customer accounts and preventing unauthorized account sharing.

Accounts that demonstrate activity reasonably indicating unauthorized distribution or resale of access may be temporarily restricted while the activity is reviewed.

15. Templates and Design Components

Email Canvas Pro may provide professionally designed templates, layouts, content blocks, buttons, calls to action, design components, and other reusable materials.

You may customize and use these materials in email campaigns and related marketing projects created for yourself, your business, your organization, or clients you are authorized to represent.

Your subscription does not grant you the right to extract, package, redistribute, sell, sublicense, or offer Email Canvas Pro's underlying template library or design components as a competing template library, software service, or downloadable collection.

16. Your Content

You retain ownership of original content that you upload or create using Email Canvas Pro, including your text, images, logos, branding, links, custom HTML, and other original materials.

By using the Service, you grant Email Canvas Pro the limited rights reasonably necessary to store, process, reproduce, display, and technically modify your content for the purpose of operating and providing Email Canvas Pro.

You are responsible for ensuring that you have the legal right to use all content uploaded to or incorporated into your templates.

17. Images, Logos, Fonts, and Other Materials

You may upload or incorporate images, logos, photographs, graphics, fonts, trademarks, copy, and other materials into templates created with Email Canvas Pro.

You are responsible for ensuring that your use of those materials complies with applicable copyright, trademark, publicity, privacy, licensing, and other laws.

Email Canvas Pro does not acquire ownership of your trademarks, logos, photographs, or other original content merely because you use them within the Service.

18. Custom HTML and User Code

Email Canvas Pro may allow you to add, modify, store, or export custom HTML and related code.

You are responsible for code that you insert, modify, or provide.

Custom HTML may behave differently depending upon the email provider, browser, device, operating system, or email client in which it is used.

Email Canvas Pro does not guarantee the performance, compatibility, appearance, or functionality of user-supplied code.

19. Email Rendering

Email technology varies among email applications, operating systems, browsers, devices, and email service providers.

Although Email Canvas Pro is designed to create email templates using generally accepted email-development practices, we cannot guarantee that every email will appear identically in every email client or environment.

Services such as Gmail, Outlook, Apple Mail, Yahoo Mail, mobile email applications, and third-party marketing platforms may interpret HTML, CSS, fonts, spacing, images, and responsive layouts differently.

20. Exported Templates

Email Canvas Pro may permit you to export, copy, download, or transfer templates for use with third-party email services.

Once a template leaves Email Canvas Pro, changes made by you or by another platform are outside our control.

Third-party platforms may rewrite, remove, sanitize, restrict, or otherwise modify HTML, CSS, links, images, fonts, tracking elements, and other portions of an exported email.

Email Canvas Pro is not responsible for changes made by third-party software after export.

21. Email Deliverability

Email Canvas Pro does not guarantee email delivery, inbox placement, open rates, click-through rates, conversions, sales, or any other marketing outcome.

Email deliverability can be affected by factors outside our control, including:

• Sender reputation;
• Sending-domain reputation;
• IP reputation;
• Your email service provider;
• SPF, DKIM, and DMARC configuration;
• Subscriber engagement;
• List quality;
• Spam filters;
• Recipient complaints;
• Message content;
• Sending frequency; and
• Policies of recipient email providers.

Email Canvas Pro is a template creation tool and is not responsible for the performance of third-party email delivery infrastructure.

22. Email Marketing Compliance

You are responsible for ensuring that email campaigns created using Email Canvas Pro comply with laws and regulations applicable to you and your recipients.

This may include requirements concerning commercial email, consent, privacy, advertising, sender identification, unsubscribe mechanisms, electronic communications, and data protection.

23. Third-Party Services

Email Canvas Pro may be used with third-party email marketing services, hosting providers, image-hosting services, browsers, payment processors, analytics providers, and other software.

Links to third-party websites or services may also be provided for convenience.

Third-party services are independently operated and are outside Email Canvas Pro's control.

The presence of a link, integration, compatibility reference, or other connection does not necessarily mean that Email Canvas Pro endorses or assumes responsibility for that third-party service.

24. Intellectual Property

Email Canvas Pro, EmailCanvasPro.com, our branding, application interface, proprietary software, templates, graphics, design systems, documentation, content, logos, and other original materials are owned by or licensed to Email Canvas Pro and are protected by applicable intellectual property laws.

Your subscription grants you a limited right to use Email Canvas Pro in accordance with these Terms. It does not transfer ownership of our software, templates, underlying source code, trademarks, branding, or other intellectual property.

You may not copy, distribute, scrape, extract, sell, rent, lease, sublicense, or create a competing product from substantial portions of proprietary Email Canvas Pro content except where we expressly authorize such use.

25. Trademarks and Branding

Nothing in these Terms grants you the right to use the Email Canvas Pro name, trademarks, service marks, logos, domain names, or other distinctive brand features except as reasonably necessary to identify the Service you use.

You may not use our branding in a manner likely to create confusion regarding sponsorship, affiliation, ownership, or endorsement.

26. Acceptable Use

Email Canvas Pro may be used only for lawful purposes.

You may not use Email Canvas Pro to create, facilitate, distribute, or promote unlawful material or to infringe the intellectual property, privacy, publicity, contractual, or other legal rights of another person or organization.

You may not intentionally interfere with, overload, attack, scrape, probe, circumvent, or gain unauthorized access to Email Canvas Pro systems.

27. Prohibited Activities

You may not:

• Sell or redistribute access to Email Canvas Pro without authorization;
• Share account credentials in violation of your subscription plan;
• Circumvent subscription, payment, trial, account, or usage controls;
• Create multiple accounts to repeatedly obtain free trials or refund eligibility;
• Copy or extract substantial portions of our template library for redistribution;
• Repackage Email Canvas Pro content as a competing product;
• Reverse engineer the Service except where applicable law expressly permits it;
• Upload malware or intentionally harmful code;
• Scrape or harvest proprietary content through automated means;
• Attempt unauthorized access to our infrastructure;
• Use the Service for fraudulent or unlawful activity; or
• Use Email Canvas Pro in a manner that infringes another party's rights.

Violation of these provisions may result in account suspension or termination.

28. Saved Templates, Account Data, and Inactive Accounts

Email Canvas Pro may allow you to save templates, designs, images, content blocks, settings, preferences, and other materials within your account.

While your subscription remains active, Email Canvas Pro will make reasonable efforts to maintain the materials stored within your account as part of providing the Service.

If your subscription expires, is canceled, or becomes inactive because of a failed payment or other reason, you may lose access to some or all stored account content.

After a period of inactivity, Email Canvas Pro may permanently delete templates, designs, images, uploaded files, content blocks, account settings, and other stored information associated with an inactive account.

We are not obligated to retain inactive account data indefinitely solely because you may choose to subscribe again in the future.

If account data has been permanently deleted, reactivating your subscription may provide access to the Service again but may not restore previously deleted templates or other content.

You are responsible for exporting, downloading, or otherwise preserving copies of important templates and materials before your account becomes inactive.

Email Canvas Pro should not be treated as your sole permanent archive or backup system for business-critical files or content.

29. Service Availability

We make reasonable efforts to keep Email Canvas Pro available and operating properly.

However, access may occasionally be interrupted due to maintenance, updates, hosting failures, software problems, network outages, third-party failures, security incidents, or other circumstances.

30. Software and Feature Changes

Email Canvas Pro is an evolving software application.

We may add, modify, redesign, replace, restrict, or discontinue features when reasonably necessary to improve the Service, address technical issues, maintain compatibility, improve performance, comply with legal obligations, or develop the product.

We do not guarantee that every feature will remain permanently available in its current form.

31. Browser and Device Compatibility

Email Canvas Pro may be designed to operate with commonly used modern web browsers and devices.

We cannot guarantee full functionality with outdated browsers, unsupported operating systems, browser extensions, restrictive network configurations, or every possible combination of hardware and software.

You are responsible for maintaining an internet connection and a reasonably current browser or device capable of accessing the Service.

32. Support

Email Canvas Pro support is provided according to the level of service included with your subscription.

We will make reasonable efforts to assist customers with account access, application functionality, templates, exports, and Email Canvas Pro product-related questions.

Email Canvas Pro support does not ordinarily include administration or troubleshooting of third-party email platforms, hosting environments, domains, DNS records, mail servers, websites, subscriber databases, or unrelated applications.

33. Suspension or Termination

We may suspend, restrict, or terminate an Email Canvas Pro account when we reasonably determine that:

• A subscription has expired;
• A required payment has failed;
• An account is being used fraudulently;
• Account credentials are being improperly shared;
• Multiple accounts are being used to circumvent subscription terms;
• The Service is being abused;
• Our systems are being attacked or improperly accessed;
• These Terms have been materially violated; or
• Suspension is reasonably necessary to protect Email Canvas Pro, our customers, or our infrastructure.

Where practical, we may provide an opportunity to resolve an issue before permanent termination.

Suspension or termination of an account may also result in loss of access to templates and other stored account data. Inactive or terminated account data may eventually be permanently deleted in accordance with these Terms.

34. Privacy

Your use of Email Canvas Pro and EmailCanvasPro.com is subject to our Privacy Policy.

The Privacy Policy describes information we collect, how that information may be used, and circumstances in which information may be processed by service providers.

35. Disclaimer of Warranties

36. Limitation of Liability

Some jurisdictions do not permit certain exclusions or limitations of liability. Where such restrictions apply, these limitations will apply only to the maximum extent permitted by law.

37. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Email Canvas Pro and its owners, officers, employees, contractors, affiliates, and service providers from third-party claims, liabilities, damages, losses, and reasonable legal expenses arising from:

• Your use of Email Canvas Pro;
• Your email campaigns or marketing activities;
• Your mailing lists or recipient data;
• Content you upload, create, distribute, or send;
• Your violation of applicable email, marketing, privacy, advertising, or data-protection laws;
• Your material violation of these Terms; or
• Your infringement of another party's legal rights.

This provision does not require you to indemnify Email Canvas Pro for claims arising solely from Email Canvas Pro's own conduct where such indemnification would be prohibited by applicable law.

38. Changes to Subscription Pricing

The subscription price applicable to your initial subscription period is the price presented when you enroll.

Email Canvas Pro may change subscription pricing for subsequent renewal periods.

Where required by applicable law, we will provide notice of a price change before the new price is charged.

If you do not agree to an applicable future renewal price, you may cancel your subscription before the renewal date.

Discounts or savings associated with an annual subscription may change over time and are not guaranteed for future renewal periods unless expressly stated otherwise.

39. Changes to These Terms

We may update these Terms to reflect changes in Email Canvas Pro, subscription offerings, business practices, technical requirements, payment practices, or applicable law.

The current version will be published on EmailCanvasPro.com and will display its most recent revision date.

Material changes will be communicated where required by applicable law.

40. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles, except where applicable consumer protection law requires otherwise.

To the extent legally permitted, legal proceedings arising from these Terms or Email Canvas Pro will be brought in the applicable state or federal courts located in Arizona, and you consent to the jurisdiction of those courts.

Nothing in this section eliminates rights that cannot legally be waived under applicable law.

41. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent legally permitted or removed to the minimum extent necessary.

The remaining provisions will continue in effect.

42. No Waiver

Our decision not to enforce a provision of these Terms on one occasion does not waive our right to enforce that provision or another provision in the future.

43. Assignment

You may not transfer or assign your Email Canvas Pro subscription, account, or rights under these Terms without our written permission.

We may transfer or assign our rights and obligations in connection with a merger, acquisition, sale of assets, corporate restructuring, or transfer of the Email Canvas Pro business, subject to applicable law.

44. Entire Agreement

These Terms, our Privacy Policy, the subscription and payment terms displayed when you enroll, and any additional written agreement expressly entered into between you and Email Canvas Pro constitute the agreement governing your use of the Service.

If a specific subscription offer contains terms that expressly differ from these general Terms, the specific terms disclosed with that offer will control with respect to that particular subscription or promotion.
